Judicial Authority and Unlawful Use of Force in the High Court

No Judge of the High Court possesses, under any provision of law or the Constitution of Ireland, the authority to direct, order, or permit members of An Garda Síochána to physically assault or remove citizens who are lawfully exercising their fundamental rights within the courts of justice. The courts belong to the People, and every person appearing before them is entitled to the protection of the Constitution and the rule of law.

Under Section 9A of the Criminal Justice (Public Order) Act 1994, a member of An Garda Síochána may only remove a person from a court in circumstances where that individual has no lawful authority or reasonable excuse to be present. A citizen exercising constitutional rights in open court clearly acts with both lawful authority and reasonable excuse. Any physical removal, intimidation, or assault of such a citizen constitutes a grave breach of duty and an abuse of power.

I personally witnessed Garda Michael McGrath, attached to Bridesgrove Garda Station, committing serious assaults upon two individuals within the High Court. Both individuals were dragged and physically assaulted—one man being pushed violently against a door, and one woman being assaulted and forced from the courtroom into the Round Hall area. These actions were entirely unprovoked and unjustified.

The presiding judge, rather than intervening to uphold the rule of law, abandoned the bench and concealed himself behind a closed door while these crimes were being committed in open court. Such conduct represents a complete abdication of judicial responsibility and a failure to safeguard the constitutional rights of the people.

No judge, Garda, or court official is above the law. Acts of physical aggression or coercion against citizens engaged in lawful proceedings must be treated as criminal offences under Irish law. The People of Ireland will not tolerate violence being perpetrated in their courts of justice, nor the evasion of accountability by those sworn to uphold the Constitution.
